Our products offered here are not a form of therapy or diagnosis in a medical sense. They do not substitute for a doctor or a naturopath. The use of the products must in no case replace, in your own interest, medical advice or help!
§ 1. General
The General Terms and Conditions apply to the sale and delivery of goods from the Aloha Treasure Island. By placing an order, the buyer declares his / her age and his / her consent to our general terms and conditions.
§ 2 Scope, Customer Information
The following general terms and conditions govern the contractual relationship between Aloha Treasure Island and consumers who purchase goods through our shop. The contract language is German.
§ 3 Conclusion of contract
The offers on the Internet represent a non-committal request to you to buy goods.
1. After entering your data and clicking on the order button, you submit a binding offer to conclude a purchase contract. You can also place a binding order but also by telephone. The confirmation of receipt of your order without delay by e-mail does not constitute acceptance of the purchase offer.
2. We are entitled to accept your offer by e-mail within 3 working days by sending an order confirmation. After expiry of the deadline stated in sentence 1, your offer shall be deemed to be rejected, that is, You are no longer bound by your offer. In the case of a telephone order, the purchase contract is concluded if we accept your offer immediately. If the offer is not accepted immediately, then you are no longer bound by it.
§ 4 Customer information: Storage of your order data
Your order with details of the concluded contract (for example type of product, price, etc.) will be stored by us. You can also call the GTC at any time after conclusion of the contract via our website.
§ 5 Customer Information: Correction Notice
You can correct your entries at any time by submitting the order. We will inform you about further corrective options on the way through the ordering process. You can also completely terminate the ordering process at any time through the browser window.
§ 6 Return costs in case of revocation
In case of revocation, you have to bear the costs of the return if the delivered goods correspond to the ordered goods. However, you only have to bear the regular costs of the return. Additional costs, e.g. By a change in our place of business or by the use of expensive transport services which we have requested, shall be borne by us.
§ 7 Reservation of title
The purchase remains our property until full payment.
§ 8 Warranty
The warranty is governed by statutory provisions. Any defects must be stated in writing immediately after receipt of the goods. In the case of justifiable defects, either free equivalent replacement or withdrawal of the item will be made. We do not accept any liability for damage or consequential damage resulting from improper handling or use by the purchaser. The right of return does not apply.
§ 9 Limitation of liability
We exclude the liability for minor negligent breaches of duty as long as these do not affect any essential duties, damages from injury to life, body or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. The duties essential to the contract include, in particular, the obligation to hand over the goods to you and to provide you with the property. Furthermore we have the matter free of material and legal deficiencies to procure.
§ 10 Prices
The indicated prices are gross prices including the legal VAT. In Germany 19% or 7%
Court of jurisdiction for all disputes arising from this contract is 86482 Aystetten.
